Response to Infringement Notices
Upon receipt of a valid copyright infringement notice, Spinah will:
- Remove or disable access to the allegedly infringing material
- Notify the alleged infringer of the removal or disabling of access
- Terminate the accounts of repeat infringers when appropriate
Counter-Notification Procedure
If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent with the following information:
- Your physical or electronic signature
- Identification of the material that has been removed or disabled and the location where it appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the federal court in your jurisdiction and that you will accept service of process from the person who provided the original copyright infringement notice
Termination Policy
Spinah reserves the right to terminate, in appropriate circumstances, users or clients who are repeat infringers. We also reserve the right to remove any content that we deem to be infringing, without prior notice, at our sole discretion.
